Stop! This Small Mistake Has a Huge Punishment

If the police caught you using your phone while driving, you are probably very mad. You think: I just looked at it for a second. It's not a big problem.

But it is a big problem. This small mistake is punished like a serious crime: 6 points on your licence and a large fine. If you already have points, this single ticket can mean you lose your licence completely. That means you can't drive, and your car insurance will become very expensive.

How can such a small mistake have such a huge punishment? Many drivers feel this law is unfair.

The Evidence is Often Very Weak

If you have a mobile phone charge, you need to ask yourself: Why have you not called us yet?

Many people who come to us have cases built on very simple proof, and it is surprising how easily these charges can be thrown out. The police cases often only use:

  • One Police Officer’s Word: A single officer says they saw the phone in your hand. The police usually do not have video proof themselves.

  • Video from a Cyclist or Another Driver: Many citizens now send videos to the police. The police then send you a Notice of Intended Prosecution (NIP), and suddenly you have 6 points coming.

The biggest problem for the police is proving these simple observations in court. Was the phone really in your hand? Was the car running? Was it even a phone, or just something else? We also ask a key question about the video: Is the footage real, or was it changed by a computer program (AI)?

You Are Giving Up Your Right to Fight

If you have a letter about a phone offence and you are thinking about just accepting the points, you are accepting a big punishment without fighting.

You are agreeing to this bad result just because you think you cannot win against the police. You are doing the police's work for them.

We treat these cases like a serious battle. We do not just ask, "Did you use the phone?" We ask about the police process:

  • Did the police follow all the time limits?

  • Is the evidence strong enough to be checked by a lawyer?

  • Did the police make any simple mistakes when giving you the NIP?

The police and the Court system are very busy. When a lawyer from PointShield Legal asks hard, specific questions and demands all the proof, the police often find it easier to drop the case than to spend time proving a simple video or one officer's word.

Don't let a small mistake stop you from driving. Stop accepting the fine and start protecting your licence.
